Welcome to KitsuneLab, offering a variety of services including hosting and development. By using our Services, you agree to comply with and be bound by the following Terms of Service ("Terms", "Agreement"). Please review these Terms carefully before using our Services.

1. Account Registration and Use

1.1. You must provide accurate, current, and complete information when engaging our Services.

1.2. You are solely responsible for maintaining the confidentiality and security of any accounts or credentials provided. You agree to notify us immediately of any unauthorized use or security breach.

1.3. We reserve the right to suspend, terminate, or refuse service for violations of these Terms, suspected fraud, or illegal activities.

1.4. You must be at least 18 years old to register and use our Services.

2. Acceptable Use Policy

2.1. This Acceptable Use Policy (AUP) outlines the acceptable and prohibited conduct for users of KitsuneLab's Services. Compliance with this policy is required to use our Services.

2.2. Prohibited Activities: Users may not use our Services to engage in, promote, or encourage illegal, abusive, or unethical activities, including but not limited to:

• Unauthorized access, monitoring, interference with, or exploiting any systems, networks, data, or accounts (hacking)
• Transmitting malware, viruses, trojans, worms, or other malicious code
• Phishing, pharming, fraud, or impersonating any person or entity
• Posting, transmitting, or disseminating spam, bulk unsolicited messages, or commercial advertising
• Cryptocurrency mining, crypto jacking, or unauthorized use of computing resources
• Intentionally circumventing security controls or exceeding authorized access permissions
• Engaging in denial of service (DoS) attacks or other intentional disruption of networks or services
• Using anonymizing proxies, VPNs, or similar tools to hide abusive conduct
• Scraping, harvesting, or collecting personal data, account information, or intellectual property without explicit permission
• Violating intellectual property rights, copyrights, trademarks, or trade secrets
• Disseminating violent, harassing, defamatory, racist, or threatening content
• Posting or transmitting child pornography or any other obscene material
• Money laundering or engaging in any illegal goods or services trade
• Any conduct that violates applicable laws and regulations

3. Intellectual Property Notice

3.1. KitsuneLab retains all rights, title, and interest in and to our trademarks, logos, copyrights, patents, trade secrets, and other intellectual property. User-generated content remains the property of the respective users, who grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with our Services. No rights are granted to use our intellectual property without express written permission.

4. Warranty Disclaimer

4.1. Our Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or secure. You use our Services at your own risk.

5. Limitation of Liability

5.1. In no event shall KitsuneLab be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages. Our total liability for any direct damages shall not exceed the total amount paid by you for the Services in the thirty (30) days immediately preceding the event giving rise to the claim.

6. Indemnification

6.1. You agree to indemnify, defend, and hold harmless KitsuneLab and its affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of our Services, violation of our policies, or violation of any third-party rights.

7. Dispute Resolution

7.1. Any dispute arising out of or relating to our Services shall be resolved through binding arbitration conducted by the American Arbitration Association, in accordance with the applicable arbitration laws and regulations in Hungary. The arbitration shall be held in Budapest, and judgment on the award may be entered in any court having jurisdiction. You agree to waive any right to participate in a class-action lawsuit or class-wide arbitration.

8. Privacy Policy

8.1. We collect basic personal information to provide our services. This information is never shared with third parties without consent, except as required by law.

8.2. Usage data may be collected to monitor performance and prevent abuse. This data is used internally only. We use Google Analytics for tracking and analyzing website usage. We do not collect personal data through Google Analytics.

8.3. We use cookies and similar tracking technologies subject to your browser settings. We disclaim liability for any data collected by third-party cookies or scripts used by customers.

8.4. Data is stored securely but no data transmission over the Internet can be guaranteed as totally secure. We are not responsible for any data loss caused by force majeure events beyond our control.

8.5. You can request to access, update, or delete your personal data. Some data may be retained after account deletion as required for legal and auditing purposes.

8.6. By using our services, you agree to comply with all applicable laws and our Acceptable Use Policy. We are not liable for any illegal or abusive conduct by customers.

9. Billing and Payments

9.1. Payments must be made in advance based on your selected plan or agreed terms. We accept payments through PayPal and Stripe. We do not collect or store any payment data; all payment processing is handled by these gateways.

9.2. All fees are non-refundable once development work has commenced.

9.3. We may change our pricing and plans at any time. Fee changes will be communicated at least 7 days in advance.

9.4. Accounts with unpaid invoices may be suspended or terminated without notice. You are responsible for all fees incurred prior to termination.

9.5. Chargebacks or payment disputes will result in immediate account termination and reporting to relevant credit agencies.

10. Developer Services

10.1. For developer services, we offer two free revisions. Additional revisions will incur an additional fee.

10.2. We provide one week of support following the completion of development services. Support can be extended for an additional fee.

10.3. Refunds for developer services are only available if the development process has not started.

11. Confidentiality

11.1. During the course of using our Services, you may be exposed to confidential information about KitsuneLab, including but not limited to trade secrets, technical data, business strategies, and financial information. You agree to maintain the confidentiality of such information and not to disclose it to any third party without our prior written consent.

12. Monitoring and Enforcement

12.1. We actively monitor our systems for illegal activities and compliance with these Terms of Service.

12.2. We reserve the right to suspend or terminate any hosted service at any time if we detect violations of these Terms of Service.

13. Data Backup

13.1. While we provide backup services for data stored on our servers, it is the user's responsibility to maintain their own backups. We are not liable for any data loss.

14. Modifications to Terms

14.1. We reserve the right to update, modify, or replace these Terms at any time. The most current version will be posted on our website.

14.2. Continued use of our Services after any modifications constitutes acceptance of the updated Terms. It is your responsibility to review the Terms periodically for changes.

15. Governing Law and Jurisdiction

15.1. These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law provisions.

15.2. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts located in Budapest, Hungary.

16. Force Majeure

16.1. KitsuneLab shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, wars, civil unrest, or internet and telecommunication failures.

17. Severability

17.1. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. Survival

18.1. Provisions of these Terms that by their nature should survive termination shall survive termination, including but not limited to intellectual property, limitation of liability, indemnification, and confidentiality obligations.

19. Entire Agreement

19.1. These Terms constitute the entire agreement between you and KitsuneLab regarding your use of our Services and supersede all prior agreements and understandings, whether written or oral.

20. Data Security and Compliance

20.1. We implement industry-standard security measures to protect your data. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee its absolute security.

20.2. We comply with applicable data protection regulations, including GDPR, where applicable. You have rights regarding your personal data, including the right to access, correct, or delete your data.

20.3. If we become aware of a data breach that affects your personal data, we will notify you in accordance with applicable laws.

21. User Responsibilities

21.1. Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their accounts.

21.2. Users must ensure that their use of the Services complies with all applicable laws and regulations.

21.3. Users agree not to share their account credentials with others and to immediately notify us of any unauthorized use of their accounts.

22. Service Availability and Maintenance

22.1. We strive to ensure that our Services are available 24/7. However, we do not guarantee 100% uptime.

22.2. Scheduled maintenance will be communicated in advance. During these periods, Services may be temporarily unavailable.

22.3. In the event of unexpected outages or technical issues, we will work to restore Services as quickly as possible.

23. Miscellaneous

23.1. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and KitsuneLab's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

23.2. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

23.3. These Terms are personal to you and may not be assigned or transferred by you without our prior written consent. We may assign, transfer, or delegate any of our rights and obligations hereunder without consent.

By using KitsuneLab's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use our Services.
